The following provisions (our “Privacy Policy”) set forth Your Privacy Rights with respect to this website and how Gold Adam, Inc. (“Gold Adam,” “we,” or “us”) collects, uses, discloses, and protects personal information in connection with our website, retail locations, gold-buying services, shipping, appraisal and payment operations, and related services. Information we collect

We respect the privacy of every individual and are committed to managing information about you responsibly. We understand the need to safeguard sensitive information that you have provided, and we will continue to handle your personal information with the same delicacy and honesty that we have throughout our company history. We collect information you provide directly, information collected automatically when you use our services, and information from third parties. These categories include:

  • Identifying & Contact Information. We collect your name, residential address, email address, and telephone number so that we can communicate with you, process transactions, and maintain accurate customer records.
  • Government ID & Verification Information. We collect government-issued photo identification (for example, a driver’s license or passport), your date of birth, and, when required by law or our compliance procedures, tax identification numbers or Social Security numbers in order to verify your identity and comply with anti-money-laundering and other regulatory obligations.
  • Transaction & Financial Information. We collect transaction details such as transaction dates, transaction amounts, item descriptions (including weight and karat), payment method references, and related payment information so that we can complete, audit, and maintain records of purchases and sales.
  • Shipping & Insurance Information. We collect shipping addresses, courier tracking numbers, and insurance claim details so that we can ship items securely, manage deliveries, and process any insurance claims.
  • Mobile or On-Site Recordings. We may record video, audio, or photographic images during in-person transactions conducted outside of a traditional retail location, including transactions conducted from company vehicles or at mutually agreed meeting locations. These recordings may be captured through vehicle- mounted cameras, mobile devices, body cameras, or other recording equipment used by our personnel. We collect and retain these recordings for legitimate business purposes, including documenting transactions, protecting the safety of employees and customers, preventing fraud or theft, and resolving disputes regarding the condition, quantity, or ownership of items involved in a transaction. We retain recordings only for a limited period of time consistent with our internal retention policies and applicable law, unless the recordings must be preserved for investigative, legal, insurance, or regulatory purposes. We disclose recordings only for legitimate business purposes, in response to lawful legal process, or as otherwise required by law.
  • Device & Online Activity Data. We collect technical and usage information such as IP addresses, browser type and version, pages visited, referral data, cookie identifiers, and other analytics data so that we can operate, analyze, and improve our website and detect security issues.
  • Workforce and Contractor Information. When individuals apply to perform services for us as independent contractors or service providers, we collect information such as resumes, business contact information, qualifications, licensing information where applicable, tax documentation, background check information where permitted by law, and other materials necessary to evaluate the individual’s qualifications and to administer the contractor relationship.
  • Information from Other Parties. We may collect or purchase information from other parties, for example marketing companies. If you have responded to or interacted with third parties who share your information with us, we collect the information the third party provides to us, including your e-mail address. Additionally, we may receive information about you from third parties such as payment processors, assay or grading laboratories, shipping carriers, and public records.
  • Communications. We collect the contents of communications sent to us through contact forms, email, telephone, or other messaging channels, and we may record telephone calls after providing notice, so that we can respond to inquiries and keep service records.
  • Social Media. We may collect information from Social Media websites (for example, Facebook ® ) upon which Gold Adam maintains a page. If you submit or post information on a Social Media website, we collect the information you provide, including your e-mail address.
  • Automated Information.We have automated means of collecting information from you when you visit our website or interact with us on the Internet. Our purpose for collecting such information is to allow user-friendly visits to our website, to inform us of activity concerning our website and to support our marketing efforts. We collect the domain from which you accessed the Internet, the date and time you accessed the website, any referring website or IP associated with that website, the pages you visit on our website or third-party sites, the length of time spent on our website and individual pages, browser type or version, and your Internet service provider.
  • Cookies and Beacons. “Cookies” are small data files that a website places on your computer. We use cookies to recognize you when you use or return to our website and to allow you to store your login information between site visits. You may elect to eliminate the use of cookies through your own browser. If you elect to eliminate the use of cookies, your ability to use our website may be adversely affected. “Beacons” are small files embedded in web pages. How we use your information

We collect and use personal information for the following purposes:

  • We collect and use personal information to verify identity and ownership of items, to process purchases and sales, to fulfill contracts, and to comply with federal and state legal obligations.
  • We collect and use personal information to ship items, to process payments and refunds, to respond to customer service inquiries, and to provide notices and other transactional communications.
  • We use personal information to prevent, detect, and investigate fraud, money- laundering, and other unlawful conduct, and we maintain internal programs to support those efforts.
  • We use device and online activity data to operate and improve our website and customer experience.
  • We use marketing contact information to send promotions or offers only when you have consented or when we have another lawful basis to do so.
  • We collect and use personal information to evaluate applications from individuals seeking to provide services as independent contractors, to verify qualifications and background information where permitted by law, and to administer contractor relationships.

KYC, AML, and required recordkeeping

We are subject to federal anti-money-laundering rules and other regulations that require identity verification and retention of certain transaction records. We therefore may require government-issued identification for certain transactions, and we will collect and record transaction details and retain those records for the periods required by law. We maintain a written anti-money-laundering program and customer-due-diligence procedures. We will not delete or destroy records that we are legally required to retain in response to a deletion request.

How we share your information

We do not sell your personal information. We may share your information in the following limited circumstances:

  • We share personal information with service providers who perform functions on our behalf, including payment processors, assay and grading laboratories, shipping carriers, insurers, analytics providers, and customer relationship management providers.
  • We may disclose personal information to law enforcement agencies, courts, or regulators when required by law or to respond to lawful process.
  • We may transfer personal information to an acquiring or successor entity in the event of a merger, sale, or other business transaction.
  • We require third-party service providers to process personal information only as we direct and to maintain appropriate security measures.

Data retention

We retain personal information only for as long as is necessary to fulfill the purposes for which it was collected and to comply with applicable legal and regulatory obligations. We retain identification and transaction records for a minimum of five (5) years to satisfy anti-money-laundering and other recordkeeping obligations, unless a longer retention period is required by law. After the applicable retention period, we securely delete or de- identify personal information in accordance with our data-retention procedures.

Opt-outs and marketing preferences

You may opt out of receiving marketing communications from us and you may exercise other opt-out rights described in this section.

  • How to opt out of marketing emails and texts. You may opt out of marketing emails by clicking the “unsubscribe” link contained in any marketing email we send you or by emailing [email protected] with the subject line “Unsubscribe — Marketing.” You may opt out of marketing text messages by replying “STOP” to any marketing SMS we send you or by emailing [email protected] with the subject line “Unsubscribe — SMS.” We will process your request as described in the “Processing and verification” subsection below.
  • Sale or sharing of personal data. Gold Adam does not sell personal information to third-parties. If we ever engage in the sale or sharing of personal data that triggers a statutory right to opt out under applicable law, we will provide a clear and conspicuous method to opt out and instructions on how to submit such a request.
  • What opt-out does and does not cover. Opting out of marketing communications will not prevent us from sending you transactional or service- related messages about purchases, receipts, shipping, payment processing, fraud prevention, or other communications necessary to fulfill our contracts or to comply with legal obligations. Opting out will also not remove records that we are required to retain by law, such as identity and transaction records retained to satisfy anti-money-laundering or tax obligations.
  • Processing and verification. We will acknowledge receipt of an opt-out request promptly and will take commercially reasonable steps to implement the opt-out as soon as practicable. For opt-out requests that require us to locate and remove your data from active marketing lists, we will generally complete processing within forty-five (45) calendar days of receiving a verifiable request. We may require reasonable verification of your identity before we process opt-out requests if doing so is necessary to prevent unauthorized changes to your preferences.
  • Limitations and residual data. After you opt out, copies of your contact information may remain in archived or backup copies of our systems for a limited period due to technical and legal constraints. We will securely delete or de- identify such data as soon as reasonably practicable in accordance with our retention policies.

Data security

We implement commercially reasonable administrative, technical, and physical safeguards to protect personal information in our possession, and those safeguards include encryption for data in transit, access controls, authentication measures, staff training, and physical security at our retail locations. Access to personal data is limited to employees who need it to do their jobs. Despite these protections, we will comply with applicable legal requirements if a security incident or data breach occurs.

Texas consumer privacy rights

Under the Texas Data Privacy and Security Act (“TDPSA”), Texas residents have the right to request certain information about how we collect, use, and disclose personal data.

  • Right to Know About Personal Data Collected and Disclosed. You have the right to request that we disclose the personal data we collect about you and how that data is used or shared. There are two types of Right to Know requests you may submit:
    • 1. Right to Know (Abbreviated Request). If you submit a Right to Know (Abbreviated Request), we will provide the following information regarding your personal data collected during the preceding twelve (12) months: (i) the categories of personal data we have collected about you; (ii) the categories of sources from which the personal data was collected; (iii) the business or commercial purposes for which the personal data was collected or processed; (iv) the categories of third parties with whom we have shared personal data; and (v) the categories of personal data that have been disclosed to third parties for business purposes.
    • 2. Right to Know (Specific Pieces of Information Request). If you submit a Right to Know (Specific Pieces of Information Request), we will provide you with the specific pieces of personal data we have collected about you, to the extent required by law.
  • Right to Correct Personal Data. You have the right to request that we correct inaccuracies in personal data that we maintain about you. If we determine that the personal data you identified is inaccurate, we will take reasonable steps to correct the information in our records.
  • Right to Delete Personal Data. You have the right to request that we delete personal data that we have collected from you or about you. This right is subject to certain legal exceptions, including situations where we are required to retain data to comply with legal obligations, complete transactions, detect security incidents, prevent fraud, or exercise legal rights.
  • Right to Opt Out of Certain Processing. You have the right to opt out of certain types of processing of your personal data, including: (i) the sale of personal data, if applicable; (ii) targeted advertising based on personal data obtained from your activities across nonaffiliated websites or online services; and (iii) certain types of automated profiling that produce legal or similarly significant effects.
  • How to Submit a Privacy Rights Request. You may submit a privacy rights request by emailing [email protected].
  • Verification and Response Timing. Before responding to a privacy request, we may require reasonable verification of your identity to ensure that the request is being made by the correct individual. We will respond to verified requests without undue delay and generally within forty-five (45) days of receipt. If reasonably necessary, we may extend the response period by an additional forty-five (45) days, in which case we will notify you of the extension.
  • Frequency and Fees. You may submit a Right to Know request up to twice within a twelve (12) month period. We will provide the requested information free of charge unless we determine that the request is manifestly unfounded, excessive, or repetitive, in which case we may charge a reasonable administrative fee or decline to act on the request as permitted by law.
  • Exceptions. Certain requests may be subject to legal exceptions. For example, we may be required to retain certain personal data in order to comply with federal anti-money-laundering laws, tax laws, legal obligations, or to protect the rights and security of our business and customers. If your request is subject to an applicable exception, we will notify you when we respond to your request.

California consumer privacy rights

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), California residents have the right to request certain information about how we collect, use, disclose, and retain personal information.

  • Right to Know About Personal Information Collected and Disclosed. You have the right to request that we disclose the personal information we collect about you and how that information is used, disclosed, sold, or shared. There are two types of Right to Know requests you may submit:

  • Right to Delete Personal Information. You have the right to request that we delete personal information that we have collected from you, subject to certain legal exceptions, including where retention is reasonably necessary to complete a transaction, comply with a legal obligation, protect the security and integrity of our systems, debug or repair functionality, exercise free speech rights, or exercise or defend legal claims.
  • Right to Correct Personal Information. You have the right to request that we correct inaccurate personal information that we maintain about you. If we determine that the personal information you identified is inaccurate, we will use commercially reasonable efforts to correct the information in our records.
  • Right to Opt Out of Sale or Sharing. You have the right to direct us not to sell or share your personal information. If applicable, you may exercise this right at any time.
  • Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to direct us to limit the use or disclosure of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer, or otherwise as permitted by law.
  • Right to No Retaliation/Non-Discrimination. We will not discriminate against you for exercising any of your rights under the CCPA, including by denying goods or services, charging different prices or rates, or providing a different level or quality of goods or services, except as otherwise permitted by law.
  • How to Submit a Privacy Rights Request. You may submit a privacy rights request by emailing [email protected].
  • Verification and Response Timing. Before responding to a privacy rights request, we may require reasonable verification of your identity. We will respond to verifiable requests without undue delay and generally within forty-five (45) days of receipt. If reasonably necessary, we may extend the response period by an additional forty-five (45) days, in which case we will notify you of the extension within the original forty-five (45)-day period.
  • Frequency and Fees. We are not obligated to provide the information required by the Right to Know provisions to the same consumer more than twice in a twelve (12) month period. We will provide the requested information free of charge unless a fee or refusal is permitted by law for a request that is manifestly unfounded or excessive, particularly because of its repetitive character.
  • Exceptions. Certain requests may be subject to legal exceptions. For example, we may be permitted or required to retain certain personal information to complete a transaction, comply with a legal obligation, protect security and integrity, debug or repair functionality, exercise free speech or other legal rights, or for other reasons permitted by law. If your request is subject to an applicable exception, we will notify you when we respond to your request.

Information from children

Our services and website are not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. Children under the age of 13 should not use this website, and we encourage parents to supervise their children while online.

Changes to our privacy policy

We may update this Privacy Policy from time to time in order to reflect changes in our practices, legal requirements, or for other operational reasons. When we make material changes, we will post the updated policy on our website together with the updated effective date.
